Medical Vaccine Exemptions in Ohio

Understanding Medical Exemptions in Ohio

In Ohio, your right to medical autonomy is protected by law. Under Ohio Revised Code (O.R.C.) 3313.671, individuals and families can seek a medical exemption from state-mandated vaccinations for school, daycare, and other settings.

A medical exemption is not simply a personal preference; it is a legal and medical recognition that a specific vaccine is unsafe or inappropriate for a particular person due to their unique health profile.

What Needs to Be Proven to Qualify?

To secure a valid medical exemption in Ohio, the law requires specific documentation. It is not enough to have a general concern; you must provide "surgical" proof that meets the following criteria:

Physician Certification: You must have a signed, written statement from a licensed physician (M.D. or D.O.) in the State of Ohio.

Medical Contraindication: The physician must certify that immunization against a specific disease is "medically contraindicated." This means that due to a medical condition, the vaccine poses a significant risk of harm. Common examples include:

Severe allergic reactions (anaphylaxis) to vaccine components.

       Documented history of adverse reactions.

Underlying immune system disorders or other chronic health conditions.

Disease-Specific Detail: The certification must specify which vaccines are being exempted. It can be a blanket exemption or specific to certain immunizations.

Note on 2026 Legislation: With the introduction of the C.H.O.I.C.E. Act (HB 561), Ohio law now further protects these rights by requiring schools to clearly communicate exemption options and prohibiting the exclusion of healthy, exempt children during outbreaks.
